Terms of Service

1. Acceptance of these terms

These Terms of Service (“Terms”) govern your access to and use of FreeQuoteGen (the “Service”), operated by FreeQuoteGen (“we”, “us”, or “our”). By using the Service, or by creating an account, you agree to these Terms. If you do not agree, do not use the Service.

Your use of the Service is also subject to our Privacy Policy, which explains how we handle personal information.

2. What the Service does

FreeQuoteGen is a free online tool that lets you create, preview, and download professional business quotations, including optional South African VAT calculations. You can build and preview quotes without an account. An account is required to save quotes and to download them as PDF files.

The Service is provided free of charge. We may introduce paid features in the future; if we do, the terms and pricing for those features will be presented to you before you incur any charge.

3. Eligibility and accounts

  • You must be at least 18 years old and able to enter into a binding contract to use the Service.
  • The Service is intended for business and professional use, not personal or consumer use.
  • You are responsible for the information you provide when registering, for keeping your login credentials secure, and for all activity that occurs under your account.
  • Notify us promptly at info@freequotegen.co.za if you believe your account has been accessed without authorisation.

4. Acceptable use

You agree not to:

  • Use the Service for any unlawful, fraudulent, or misleading purpose
  • Create quotes containing false, deceptive, or infringing content, or impersonate another person or business
  • Upload or transmit malware, or attempt to gain unauthorised access to the Service, other accounts, or our systems
  • Probe, scan, or test the vulnerability of the Service, or breach any security or authentication measures
  • Scrape, harvest, or bulk-export data from the Service, or use automated means to access it in a way that places unreasonable load on our infrastructure
  • Reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent this restriction is prohibited by law
  • Resell, sublicense, or commercially exploit the Service without our consent

We may suspend or terminate access for any account that we reasonably believe is breaching these Terms.

5. Your content

“Your Content” means the information you enter into the Service, including your business details, your clients’ details, line items, pricing, notes, and terms. As between you and us, you retain all rights in Your Content.

You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and process Your Content solely to operate and provide the Service to you (for example, to render previews, generate PDFs, and display your saved quotes).

You are responsible for Your Content, and you represent that:

  • It is accurate and not misleading;
  • You have the right to provide it to us, including any personal information about your clients, and you have a lawful basis to do so and have informed those individuals as required by law; and
  • It does not infringe the rights of any third party or violate any law.

6. Quotes, VAT, and no professional advice

  • A document you generate with the Service is a quotation — an offer or estimate you provide to your client. It is not an invoice, a tax invoice, a receipt, or a binding contract, and creating one through the Service does not form any agreement between you and your client.
  • VAT and total calculations are provided as a convenience based on the rate and settings you choose. You are responsible for checking that they are correct for your circumstances. We do not provide tax, accounting, legal, or financial advice.
  • You should confirm VAT treatment, registration requirements, and invoicing rules with a qualified professional or the South African Revenue Service.

7. Availability and changes

We aim to keep the Service available and working, but we provide it on an “as is” and “as available” basis. We may modify, suspend, or discontinue any part of the Service at any time, and we may set limits on storage or usage. Where practical, we will give reasonable notice of material changes that negatively affect you.

We are not responsible for any loss resulting from downtime, data loss, or changes to the Service. You are responsible for keeping your own copies of important quotes.

8. Third-party services

The Service relies on third-party providers for functions such as authentication (for example, Google sign-in), hosting, database storage, PDF generation, and analytics. Your use of those functions may also be subject to the third party’s own terms. We are not responsible for third-party services we do not control.

9. Our intellectual property

The Service, including its software, design, templates, layouts, text, and branding (but excluding Your Content), is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service and to use the quote documents you generate for your own business purposes. All rights not expressly granted are reserved.

10. Disclaimers

To the fullest extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any calculation or output will meet your requirements or comply with any particular law.

Nothing in these Terms excludes or limits any right you have under the Consumer Protection Act, 2008 or other South African law that cannot lawfully be excluded or limited.

11. Limitation of liability

To the fullest extent permitted by law, and except for liability that cannot lawfully be excluded:

  • We will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to your use of the Service; and
  • Our total aggregate liability arising out of or relating to the Service or these Terms will not exceed ZAR 1,000, or, if greater, the amount you have paid us for the Service in the 12 months before the event giving rise to the claim (which, for a free account, is zero).

12. Indemnity

You agree to indemnify and hold us harmless from any claims, losses, liabilities, and reasonable expenses (including legal fees) arising out of Your Content, your use of the Service, or your breach of these Terms, except to the extent caused by our own gross negligence or wilful misconduct.

13. Termination

You may stop using the Service at any time and delete your account from the dashboard. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. On termination, your right to use the Service ends. Sections that by their nature should survive termination — including content licence terms, disclaimers, limitation of liability, and indemnity — will survive.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa, without regard to its conflict of laws rules. You submit to the non-exclusive jurisdiction of the South African courts. Before starting formal proceedings, you agree to first contact us to try to resolve the dispute in good faith.

15. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you through the Service. Your continued use of the Service after a change takes effect means you accept the revised Terms.
